Terms & Conditions of Sale

How we quote, proof, manufacture and deliver custom packaging, and what happens if something is not right.

These terms set out how Custom Boxez quotes, manufactures and delivers custom packaging. Because every box we make is produced to your own dimensions and artwork, a few of them matter more than they would for an off-the-shelf product. Please read them before you approve a proof.

Who these terms apply to

Custom Boxez is the trading name of Custom Boxez Limited, 1846 E. Innovation Park Dr. STE 100, Oro Valley, AZ 85755. We sell custom printed boxes and packaging to businesses and organizations in the United States.

These terms apply to every quotation we issue and every order we accept, together with the details set out in your quotation and our order acknowledgment. If anything in a quotation or order acknowledgment differs from these terms, the quotation or order acknowledgment applies to that order. By approving a proof or paying for an order, you accept these terms on behalf of the business placing the order.

We do not sell to consumers for personal use through this website. If you are ordering as an individual, please tell us before you place the order so we can explain what applies.

Quotations and validity

Every job is quoted individually from the details you give us: packaging type, dimensions, quantity, board or material, print, finishes and any inserts or accessories. Our minimum order is 50 boxes.

A quotation is valid for the period stated on it. If you accept after that period, or if the specification changes, we may need to re-quote. Prices are stated in US dollars. Free shipping, free lamination and no die charges are standard on every order; anything else that is included or excluded is listed on the quotation.

Custom manufacturing and your specifications

Your packaging is made to order from the dimensions, materials and finishes you approve. We do not hold finished stock, and a finished custom box cannot be resold to anyone else. That is why the specification you approve, and the proof you approve, are the basis for what we make.

You are responsible for making sure that the dimensions you give us are right for your product and that the packaging style, board and finishes you choose are suitable for the way your product will be packed, shipped and sold. We will advise where we can, and we will tell you if we think something will not work, but the final choice is yours.

Artwork, dielines and design support

There are two ways to supply artwork. You can send print-ready vector files (for example AI, EPS or PDF) placed on the dieline we supply for your box, or our design team can prepare the artwork for you from your logo, brand assets and references. Either way, you approve a proof before anything is printed.

If you supply your own files, they need to be at the finished size, with fonts outlined or embedded, images at a resolution suitable for print, and colors set up for the print process agreed in your quotation. Files that do not meet these requirements may print differently from how they appear on screen, and we will tell you if we see a problem before proofing. If design support is included in your quotation, its scope and any rounds of revision are as set out there.

Intellectual property in your artwork

You keep ownership of your logos, artwork, brand names and any other content you give us. You give us a license to use that content only to prepare proofs, manufacture your packaging, produce any samples and keep the records we need for the order.

You warrant that you own or have permission to use everything in your artwork, including logos, images, fonts, trademarks and any regulated product claims, and that printing it will not infringe anyone else's rights. If a third party makes a claim against us because of content you supplied, you agree to cover the costs and losses that result.

Dielines, structural designs and production files that we create remain ours, although you are free to use the finished packaging however you wish. We may photograph finished work for our portfolio unless you ask us not to.

Proof approval

Before production we send you a digital proof showing the artwork on the dieline. Please check it carefully: spelling, dimensions, panel layout, orientation, bleed, barcodes, colors and every piece of text. Once you approve the proof, we manufacture to it. Errors that were visible on the approved proof are not a manufacturing defect, and correcting them afterwards means a new order.

A digital proof shows layout and content. It cannot show exact printed color, because screens and print behave differently. If precise color is critical, tell us before you approve and we will discuss options with you.

Production does not begin until we have both your proof approval and payment as set out in your quotation. Time taken to approve a proof or to supply corrected artwork is not counted in the production lead time.

Samples

Standalone samples are chargeable. Making one box, or a small number of boxes, needs essentially the same setup and production steps as a bulk run, so a standalone sample carries a charge that we quote in advance.

For qualifying bulk production orders, once the order is placed we can produce a pre-production sample for your approval at no additional sample charge. After you approve that sample, the remaining production quantity proceeds. Whether an order qualifies, and how the sample affects the overall timeline, is set out in your quotation.

Orders, acceptance and payment

There is no online checkout on our website. When you accept a quotation, our sales team acknowledges the order by email and sends payment instructions. Your order is accepted when we issue that acknowledgment; until then we are free to decline an order, for example if the artwork cannot be printed as supplied or the content is unlawful.

Payment terms, including when payment is due and the methods we accept, are as set out in your quotation and order acknowledgment. The website does not take card or bank details; payment is arranged with our sales team. Any sales or use tax that applies to your order is handled as stated on your quotation or invoice, and if you hold a valid exemption certificate please send it to us before the order is invoiced.

Production lead time

Standard production takes 10 to 12 working days, counted from the day we have both your proof approval and payment. Working days are Monday to Friday, excluding US public holidays.

Where a pre-production sample is part of the order, the production clock for the remaining quantity runs from your approval of that sample. Lead times for complex structures, special finishes or very large quantities are stated on your quotation where they differ from the standard. We will tell you promptly if anything is likely to delay your order.

Changes after approval and cancellations

Before proof approval, you can change the specification or artwork freely; we will re-quote if the change affects price or timing. After proof approval, materials are ordered and the job is scheduled, so changes are only possible if production has not started, and they may involve additional cost and a new lead time.

If you cancel an order after approving the proof, you are responsible for the costs we have already incurred for that order, such as materials, tooling, design work and any production completed. Because custom packaging cannot be resold, a cancellation once production is under way may mean the full order value is payable. The charges that apply to a cancellation at each stage are as set out in your quotation and order acknowledgment, and we will always tell you what they are before we act on a cancellation.

Manufacturing tolerances, color and over-runs

Packaging is manufactured, not machined. Small variations in dimensions, board caliper, print registration, finish and color are normal across a run and from one run to the next, and they are not a defect. We work to industry-standard tolerances for the material and process used, and any specific tolerance that applies to your order is set out in your quotation.

Printed color can differ from what you see on screen, from a previous run and between different materials and finishes; a matte lamination, for example, will soften color compared with the same ink under gloss. We match to the agreed reference as closely as the process allows, but exact color matching cannot be guaranteed unless a physical color standard has been agreed in writing.

It is standard in packaging manufacturing for the delivered quantity to vary slightly from the quantity ordered. Any over-run or under-run allowance, and how it is invoiced, is as set out in your quotation and order acknowledgment.

Delivery

Delivery is free on every order to addresses within the United States. After production is complete, standard ground shipping takes an additional 3 to 5 working days. The delivery address is the one on your order acknowledgment; if you need delivery to more than one address, or a faster service, tell us when you request your quotation so we can include it.

Please check the delivery address carefully. If a consignment cannot be delivered because the address you gave us was incomplete or incorrect, or because no one was available to receive it, the cost of returning, re-shipping or redirecting it is charged to you.

Transit times are estimates. Carriers can be delayed by weather, volume and other events outside our control, and we are not responsible for those delays or for any loss that results from them. Risk in the goods passes to you when the carrier delivers them to the address on the order.

Damage, shortages and claims

Please inspect your order as soon as it arrives and before the packaging is put into use. If cartons arrive visibly damaged, note it with the carrier at the time of delivery and keep the packaging so the damage can be documented.

If there is a shortage, transit damage or a manufacturing defect, let us know at sales@customboxez.com within the claim period stated on your quotation and order acknowledgment, with your order reference, a description of the problem and photographs. We will investigate promptly and may ask for a sample of the affected boxes to be returned. Claims for problems that were visible on the approved proof, or that fall within the tolerances described above, are not accepted.

Reprints and refunds

If we accept that an order was not manufactured to the approved proof and specification, our first remedy is to reprint the affected quantity at our cost. Where a reprint is not practical, we will agree an alternative remedy with you, which may include a credit or a refund for the affected quantity. The remedies available for a particular order are as set out in your quotation and order acknowledgment.

Reprints and refunds do not apply to errors in the artwork or specification you approved, to color variation within normal process tolerances, or to packaging that has been used, altered or filled.

Prohibited and unlawful content

We will not print content that is unlawful, that infringes someone else's intellectual property, that is defamatory, obscene or hateful, or that makes regulated claims you are not entitled to make. We may decline any order that we reasonably believe falls into one of those categories, or that we are not willing to produce, and we will tell you if we do.

You are responsible for making sure that your packaging complies with any labeling, safety or regulatory requirements that apply to your product and the markets it is sold in. We do not check regulatory compliance unless it is expressly included in your quotation.

Website content and intellectual property

The content of customboxez.com, including text, photography, guides, dielines, illustrations, page layouts and the Custom Boxez name and logo, belongs to Custom Boxez or its licensors. You may view and print pages for your own use in dealing with us. You may not copy, republish or use our content for any other purpose without our written permission.

You agree to use the website only for its intended purpose, and not to interfere with its operation, attempt to gain unauthorized access to any part of it, or use automated tools to extract its content.

Limitation of liability

Nothing in these terms limits liability for anything that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.

Subject to that, we are not liable for indirect or consequential losses arising from an order, such as lost profits, lost sales, missed launch dates or the cost of goods that were to be packed in the packaging. Our total liability in connection with any order is limited as set out in your quotation and order acknowledgment. Our responsibility is to manufacture your packaging to the approved proof and specification and deliver it as described in these terms, and the remedies in the sections above are the remedies available to you.

Events outside our control

We are not responsible for failing to do something, or for delay in doing it, when the cause is outside our reasonable control. Examples include material shortages, supplier failures, carrier disruption, severe weather, natural disasters, epidemics, strikes, utility or internet failures, and government action. If such an event affects your order, we will tell you as soon as we can, explain the likely effect on timing, and agree with you how to proceed.

Changes to these terms

We may update these terms from time to time. The version in force when we issue your quotation applies to that order, and the effective date at the bottom of this page shows when the current version took effect. These terms, your quotation and our order acknowledgment together form the whole agreement for each order. If any part of these terms is found to be unenforceable, the rest continues to apply.

The law that governs these terms and the courts that hear any dispute are as stated in your quotation and order acknowledgment. Before either of us starts formal proceedings, we ask that you contact us so we can try to resolve the matter directly.
